In these two instances, Shankara cites the Bh.Gita as 'said by Vyasa':

On some occasions, Shankara cites the Gita as 'Smriti':

Citing the Mahabharata as Smriti: स्मृतेश्च — ‘अथ सत्यवतः कायात्पाशबद्धं
वशं गतम् । अङ्गुष्ठमात्रं पुरुषं निश्चकर्ष यमो बलात्’ (म. भा. ३ । २९७ । १७)
इति ।
Under the Brahma sutra 'smrtEshcha' 1.2.6 Shankara cites two Gita verses.
In another sutra by the same name 1.3.30 Shankara cites Vishnu Purana for
smriti. In yet another sutra under smriti, Gautama Dharma sutra is cited.
Elsewhere another smriti is cited.
We see that whichever smriti it is, including the Bh.Gita, the Sutrakara
intends to call it a 'smriti.'
